The use of the Pinnacle Sports website and online store is governed by the terms and conditions set out below. Please read these Terms & Conditions carefully.

By using our website, creating an account, placing an order, purchasing a Gift Card, or booking a course or activity with Pinnacle Sports, you agree to these Terms & Conditions and any additional terms that apply to the product or service you purchase.

These Terms & Conditions operate alongside, and do not replace or limit, your rights under the Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

About Pinnacle Sports

Pinnacle Sports is a trading name of Highpoint Adventures Pty Ltd.

In these Terms & Conditions, "Pinnacle Sports", "we", "us" and "our" refer to Highpoint Adventures Pty Ltd trading as Pinnacle Sports.

"you" and "your" refer to the person using our website or purchasing products or services from us.

Website Use

You may use the Pinnacle Sports website for lawful purposes and in accordance with these Terms & Conditions.

You must not use our website:

• for any unlawful, fraudulent or unauthorised purpose;

• to interfere with the operation or security of the website;

• to attempt to gain unauthorised access to our systems or accounts;

• to introduce viruses, malicious code or other harmful material; or

• to copy, reproduce or commercially exploit website content without our permission.

We reserve the right to suspend or restrict access to our website where reasonably necessary to protect our business, customers or website.

Customer Accounts

Some features of our website may require you to create an account.

You are responsible for keeping your account information and password secure and confidential. You should not allow another person to use your account or provide them with your password.

You are responsible for activity carried out through your account unless the activity results from circumstances outside your reasonable control.

Please contact us as soon as possible if you believe your account has been accessed without your permission.

Orders

When you place an order through our online store, you are making an offer to purchase the products selected in your order.

Your order confirmation confirms that we have received your order. It does not necessarily mean that we have accepted your order.

We reserve the right to accept or decline an order for a reasonable reason, including where:

• a product is unavailable;

• there is an obvious pricing, product or website error;

• payment cannot be verified or processed;

• we reasonably suspect fraudulent or unauthorised activity;

• an order appears to be intended for unauthorised resale; or

• we are unable to fulfil the order for another legitimate reason.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.

We may contact you if additional information or verification is required before an order can be processed.

Product Availability

We do our best to keep the information on our website accurate and up to date.

Product availability can change quickly, and products, colours, sizes and variations may occasionally become unavailable.

If an item you have ordered becomes unavailable before your order can be fulfilled, we will contact you and provide an appropriate option, which may include a refund for the unavailable item.

We cannot guarantee that every product shown on our website will be available at all times.

Product Information

We make reasonable efforts to ensure that product descriptions, specifications and photographs are accurate.

However, the appearance of products may vary slightly from photographs displayed on your screen, including due to differences between monitors and devices.

Product specifications may also change from time to time as manufacturers update their products.

If you have questions about the suitability of a product for your intended use, particularly climbing, rescue or safety equipment, please contact us before purchasing.

Pricing

All prices displayed on the Pinnacle Sports website are in Australian dollars (AUD).

Prices include GST where applicable.

We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted.

If a product has been listed at an obviously incorrect price due to a website or administrative error, we may contact you before processing the order. Where an order cannot reasonably be fulfilled at the incorrect price, we may cancel the order and provide a full refund.

Payment & Security

Payment must be made using one of the payment methods available during checkout.

By submitting an order, you confirm that you are authorised to use the selected payment method and authorise us to process payment for the order, including applicable taxes, shipping and other charges shown at checkout.

If payment cannot be verified, is declined or is otherwise unavailable, we may suspend or cancel the order.

Payment information is processed through our payment providers. Pinnacle Sports does not intentionally retain complete payment card details.

Shipping & Delivery

We currently ship online orders within Australia only.

We aim to dispatch orders as quickly as possible. Delivery timeframes provided on our website or during checkout are estimates and are not guaranteed.

Delivery may be delayed by circumstances outside our reasonable control, including courier delays, weather, natural disasters, public holidays, peak periods and other transport disruptions.

We may make partial deliveries where some items in an order are available before others.

Please ensure that your delivery address is correct before completing your order. If you notice an error in your delivery address, contact us as soon as possible.

We will make reasonable efforts to update an address before an order is dispatched, but we cannot guarantee that changes can be made once an order has entered our fulfilment process.

Returns, Refunds & Consumer Guarantees

Our returns and refund procedures are set out in our Returns & Refunds Policy.

Nothing in these Terms & Conditions limits, excludes or modifies your rights under the Australian Consumer Law or any other law that cannot legally be excluded.

Products supplied by Pinnacle Sports are covered by applicable consumer guarantees under Australian Consumer Law.

If a product does not meet an applicable consumer guarantee, you may be entitled to a remedy, which may include a repair, replacement or refund depending on the circumstances.

These consumer guarantees apply in addition to any manufacturer's warranty.

Gift Cards

Pinnacle Sports offers Equipment Gift Cards and Activity & Course Gift Cards.

Gift Cards are subject to the Gift Card Terms & Conditions applicable to the type of Gift Card purchased.

Gift Cards cannot be exchanged for cash except where required by law.

Nothing in our Gift Card Terms & Conditions limits your rights under Australian Consumer Law.

Courses, Workshops & Activities

Pinnacle Sports provides climbing courses, workshops, guided activities and other adventure experiences.

These activities may involve inherent risks, including the risk of serious injury or death.

Additional terms apply to participation in our activities and courses. Before participating, you may be required to acknowledge and agree to our Activity Terms & Conditions, course requirements, participant declarations or other applicable documents.

You are responsible for:

• following reasonable instructions provided by our guides and staff;

• complying with applicable safety requirements;

• providing accurate information requested by Pinnacle Sports;

• advising us of any information that may reasonably affect your ability to participate safely; and

• meeting any age, experience, fitness or other requirements specified for the activity.

We may refuse or restrict participation where we reasonably believe that participation presents an unacceptable safety risk to you, our staff, guides or other participants.

Where reasonably practicable, we will discuss the circumstances with you and consider appropriate alternatives.

Equipment & Safety

Climbing and adventure activities require appropriate equipment, knowledge, training and judgement.

When purchasing climbing, rescue or safety equipment, you are responsible for using the equipment in accordance with the manufacturer's instructions and applicable safety requirements.

Pinnacle Sports recommends that safety equipment is inspected, maintained and retired in accordance with the manufacturer's requirements.

Unless specifically stated otherwise, purchasing equipment from Pinnacle Sports does not constitute training in the use of that equipment.

If you are unsure whether a particular item is suitable for your intended use, please contact us before purchasing.

International Orders

Pinnacle Sports currently accepts online orders for delivery within Australia only.

We do not ship online orders internationally.

Promotions & Discounts

From time to time, Pinnacle Sports may offer promotional pricing, discount codes, competitions or other special offers.

Additional terms may apply to individual promotions and will be provided with the relevant offer.

Unless otherwise stated, promotions and discount codes cannot be combined.

We reserve the right to withdraw or amend a promotion where reasonably necessary, subject to applicable law and any specific terms applying to the promotion.

Website Content & Copyright

All content on the Pinnacle Sports website, including text, photographs, graphics, logos, videos, designs and other materials, is owned by Pinnacle Sports, Highpoint Adventures Pty Ltd or the relevant third-party rights holder.

You may access and use website content for personal, non-commercial purposes.

You must not copy, reproduce, modify, publish, distribute or commercially exploit website content without our written permission, except where permitted by law.

You are welcome to share links to Pinnacle Sports webpages for personal and non-commercial purposes.

To the maximum extent permitted by law, Pinnacle Sports will not be responsible for loss or damage arising from circumstances outside our reasonable control.

Where our liability can legally be limited, we will limit our liability only to the extent permitted by law.

For services supplied to consumers, any limitation of liability is subject to the Australian Consumer Law.

Events Outside Our Reasonable Control

We are not responsible for delays, cancellations or failures caused by circumstances outside our reasonable control.

These circumstances may include severe weather, natural disasters, fire, flood, government restrictions, road or park closures, industrial action, illness, infrastructure failures, supplier disruptions, transport delays or other unforeseen circumstances.

Where an event affects an order, course or activity, we will take reasonable steps to communicate with affected customers and, where appropriate, provide alternative arrangements.

Your rights under Australian Consumer Law continue to apply.

We may update these Terms & Conditions from time to time to reflect changes to our business, website, products, services or legal requirements.

The current version will always be published on this page and will include the date it was last updated.

Changes will not retrospectively affect rights or obligations that have already arisen, except where permitted or required by law.

Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any dispute relating to these Terms & Conditions or your dealings with Pinnacle Sports will be subject to the applicable laws and courts of Queensland, subject to any rights you may have under Australian law.

Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify your rights under the Australian Consumer Law or any other applicable law.

Where there is an inconsistency between these Terms & Conditions and a mandatory legal right or requirement, the mandatory legal right or requirement will apply.
